Epicine - Y'all Want a Caterwaul

It's not up for download anywhere at the moment. I didn't get permission to write that very obvious parody, and I'd rather not get sued for distribution rights. Sure, chances are minimal, but I don't golf in the rain either.

Nope, but it gets complicated. That parody is a few years old, and has already been distributed like crazy. I'll eventually get paranoid enough to take it down off the public site, but for right now I have considerably less paranoia over that one than I would over a more "recent" korn song.

Aren't there certain rules as well, stating that once a song, or some such other overrides a certain ammount of years, it's up for grabs and modification?

I know that's how Weird Al made the "Amish Paradise" even tho Coolio tried to sue him... But to no avail as the song was no longer protected...

For works created on or after January 1, 1978: copyright lasts for life of author plus 70 years
For pre-1978 works still protected by their original or renewed copyright: the total length of their copyright is extended to 95 years from the date the copyright was originally secured

Note, works created before 1978 that weren't renewed before their original date expired became public domain.

The issue is satire vs parody, which the distinction between the two isn't all that well defined through court cases. I don't know if any of you guys heard of the 'This land is our land' cartoon from a few months ago. This was a similar issue. It was never resolve though because the original copyright over the song ran out and was never renewed by the company who said they owned the copyright.

Parody is protected by fair use. It could be parody of what the song is about, parody of the artist, or a parody of the song itself. The reason Weird Al got off is mainly because he makes fun of Coolio and the seriousness of the original song.

Weird Al would have lost if his work was a satire, which would mean it's making fun of something different using only the features of the song. That's not protected by fair use and is usually what gets people in trouble. That's more than likely the reason why Tarryk would be worried in any way.
